Murtha Continues Earmark Funding for His Own Airport

JOHNSTOWN, Pa. -- An expensive airport radar system that became a national symbol of wasteful government spending may finally be put into service soon at the John Murtha Johnstown-Cambria Airport.

The Digital Airport Surveillance Radar system cost about $8 million of federal money, but has been sitting idle since it was built in 2004.

The system was not in use because the Pennsylvania National Guard didn't have the funding for the positions. However, officials said they have the funding now and plan to have the system up and running by spring.

A spokesperson for the National Guard said the group is waiting for more equipment to get the system up and running. Twelve people will be hired to run the radar, which can track planes miles away and give pilots weather conditions. . . . [Full Story /Video]

GOP Sets Sights on House Power Brokers for 2010. This tells me that the professional odds makers have done extensive polling in the district and find John Murtha vulnerable in 2010. Pat Toomey will be running [for Senate] in 2010 and Pat Toomey will expose the Pelosi Murtha economic policies as ineffective. Unfortunately, I don’t think employment will be significantly down by November 2010. In my opinion, the economy will be worse by Nov. 2010 election

Open Letter to Editor - Health Care Bill

Dear Congressmen;

You have been entrusted with one of the most significant tasks that Congress has tackled in many years - health care for all citizens.

I am truly dismayed that both parties have chosen to make this a partisan battle wrought with finger pointing in all directions. Do you ever ask, how many people have died and how many bonuses insurance CEOs received while you were debating for political gain?

Congress needs to act now for the benefit of the citizens. Insurance companies need to be banned from lobbying and favors and high bonuses. Reducing bonuses and Congress payoffs could cover the costs of a national insurance plan.

Another way to pay for a truly adequate bill would be for Congress to give up one or two wasteful "pork" projects that are handed out regularly. There are many ways for this bill to happen in a real effort to help citizens but Congress has to care.

If the extreme partisanship and bitter fighting continues, you leave the voters no choice but to replace incumbent Congressmen and women with new people who will be working for their voters not their payoffs. This has become a very popular option among the voting public.

Philadelphia Inquirer Calls for Isolation of Pork King John Murtha

The Philadelphia Inquirer Editorial: Congressional Democrats have made modest progress in their efforts to limit pork-barrel spending projects known as "earmarks." And then there's Rep. John Murtha (D-PA). Murtha is chairman of the House Appropriations defense subcommittee, a post in which he has earned the title as Pennsylvania's "King of Pork." In last month's defense bill alone, Murtha led all House lawmakers by sponsoring 23 earmarks worth $76.5 million. In a career spanning nearly 40 years, Murtha has directed billions back to his Johnstown-area district.

All that federal largesse means more jobs for Pennsylvanians, right? Well, yes, but some of those Murtha-created jobs have cost the federal government as much as $2 million apiece. Taxpayers can't afford that kind of subsidized make-work program.  One Murtha-sponsored technology firm, Caracal Inc., opened in Ford City, Pa., in 2005 with at least $153 million from taxpayers. It closed after three years, and employed 10 people at its height of operations. A company called Planning Systems Inc. of Uniontown, Pa., spent about $7 million in federal earmarks - to generate four jobs.

Some defense-related companies have thrived with the help of Murtha's earmarks, expanding to create hundreds of jobs. But a Washington Post analysis of Murtha's earmarks found that, of 16 companies he helped to win funding, 10 generated far fewer jobs than promised, and half of those have closed operations in his district.

Murtha's earmarks have attracted the attention of investigators at the Justice Department and the Pentagon. The Navy has barred Kuchera Defense Systems Inc. of Windber, Pa., from obtaining any more government contracts because it allegedly engaged in fraud. Kuchera and subsidiaries have received about $50 million in earmarks through Murtha. Its employees also have been generous campaign contributors to the congressman.

Justice officials are investigating a lobbying firm, PMA Group, that enjoyed remarkable success in winning defense earmarks for its clients. But House ethics officials last month recommended taking no action over Murtha's relationship with PMA.

The congressman's piggish habits overshadow Democrats' relative success in curbing earmarks. The Democrat-controlled Congress is on a pace to spend about $11 billion on earmarks in fiscal 2010, about $4 billion less than last year.

When Republicans controlled Congress in 2005, earmarks had reached at least $19 billion. The worst abuses led to some lawmakers going to prison. (Of course, even trimming pork projects down to $11 billion this year is a pittance, compared with the overall increase in federal spending and last year's deficit of $1.4 trillion.)

Democrats also have succeeded in pushing through more transparency in earmarks, allowing the public to scrutinize lawmakers' individual requests before they come up for a vote. Previously, these projects were often inserted into spending bills at the last minute. Sometimes it was impossible even to tell which lawmakers had requested them.

But progress goes only so far. Earmark opponents in Congress failed to win a single anti-earmark vote on the floor of the House or the Senate last year. Rep. Jeff Flake (R-AZ) tried and failed 48 times to defeat individual earmarks.

Not all earmarks are wasteful. Many are directed to hospitals, homeless shelters, and colleges that put the money to good use. If not for earmarks, some of this money would be spent anyway through the regular appropriations process. But if Congress intends to get serious about curbing its appetite for debt, lawmakers need to further isolate the examples of pork kings such as Murtha.

Government Suspends Contractor Previously Supported by Murtha

Politico reports that a Pennsylvania defense contractor that received earmarks from Rep. John Murtha (D-Pa.) has been barred from receiving further government contracts after allegedly offering kickbacks to another federal contractor. The Navy suspended Kuchera Defense Systems Inc., and its two owners, brothers Bill and Ronald Kuchera, from entering into new contracts with the federal government . . . The suspension took effect Dec. 22, and it marks the second time in less than a year that the firm was barred from new business with the government. Kuchera, based in Windber, Pa, has relied heavily on support from Murtha, who chairs the powerful Defense Appropriations Subcommittee. . . . The suspension follows a case last year in which two former Air Force officers were sentenced to federal prison after being found guilty of engaging in a fraudulent scheme related to an $8 million earmark obtained by Murtha. . . . Murtha has steered more than $50 million in earmarks to several Kuchera-owned companies. Employees at those companies have donated about $65,000 to Murtha’s campaigns, and the brothers hosted a fundraiser for Murtha at their Pennsylvania ranch. Jack Murtha’s Quid Pro Quo and Vaccine Kickbacks

Several months ago we warned that Tara O’Toole who recently became Under Secretary for the Science and Technology Directorate at the Department of Homeland Security would reward her friends resulting in millions of dollars in gifts to John Murtha cronies who supported her nomination.

And it now appears the Murtha/O’Toole favor factory has begun production. In February 2008, the Department of Health and Human Services (HHS) issued a request for proposal (RFP) for a second-generation Anthrax vaccine. This RFP was issued to be a re-procurement for a contract that had been canceled in 2006 for the same vaccine. And on December 7, HHS canceled the RFP.

After further review, it is becoming all too clear why this happened. Just as the year was closing and no one was paying attention, O’Toole’s friends at PharmAthene were awarded a sole-source contract, which has resulted in their stock nearly doubling. In the very same week America faced al Qaeda’s latest terrorist attack, it seems that the O’Toole-led homeland security “system worked” for PharmAthene — assuming the system is one of cronyism, political paybacks, and sole-source contracts.

This leads one to ask, who is PharmAthene, what are O’Toole’s ties, and why would the government single them out for a sole source giveaway at taxpayer expense?

PharmAthene is a company founded and run by Murtha cronies who have extremely close ties to O’Toole. In fact, O’Toole was head of the Center for Biosecurity, which is connected to the University of Pittsburgh Medical Center (UPMC), and both Murtha and O’Toole’s friends are working feverishly to position UPMC for a major biosecurity, vaccine-production contract that would result in billions flowing to Murtha’s district, and O’Toole’s private equity and lobbyist friends. According a recent report, this facility would be run by a mysterious unnamed biotechnology company. Anyone care to guess who that unnamed company is rumored to be?

PharmAthene was founded by Joel McCleary, who also happens to be a founding partner at a DC-based private equity firm, Four Seasons Ventures, and an advisor to UPMC. Partnered with McCleary at Four Seasons is none other than James Ervin, a former Murtha aid and the man one goes to for a Murtha earmark, a favor PharmAthene has benefited from in the past. Ervin lobbies for PharmAthene and Four Seasons is heavily invested.

And that’s where O’Toole comes in. In addition to running the Center for Biosecurity, O’Toole advised the Alliance for Biosecurity, which we now know PharmAthene basically runs. As the Washington Times reported, “President Obama’s nominee at the Department of Homeland Security overseeing bioterrorism defense has served as a key adviser for a lobbying group funded by the pharmaceutical industry that has asked the government to spend more money for anthrax vaccines and biodefense research.”

So this comes full circle. After doing business in the private sector, O’Toole is now in a position to continue to do business with Murtha’s people at PharmAthene, except this time, it’s with taxpayer dollars.

And it’s not as if this wasn’t a concern during her nomination hearings. As obtained by THE WEEKLY STANDARD, Senator Tom Coburn specifically asked O’Toole on June 10, “What are your views on whether the United States should fund development of a second generation anthrax vaccine? Given that Pharmathene is competing for this effort, will you recuse yourself from any role in the decision whether to support this effort?” O’Toole’s response, “I will, of course, adhere to all Executive Branch ethics requirements in consultation with the Department’s Designated Agency Ethics Official with respect to conflicts of interest. I will recuse myself from any matter in which I have a conflict of interest or the appearance of a conflict as outlined in my Ethics Agreement which has been submitted to this Committee. With regard to Pharmathene, I have, as noted above, no financial interest in the company and am not aware of any current recusal requirements.”

So O’Toole states she will not recuse herself and the favor factory begins production. Anyone concerned with this sole-source contract to O’Toole friends at PharmAthene — a wholly owned subsidiary of John Murtha, Inc. — has until January 13 to voice concerns in an effort to keep it from becoming finalized.
But with all that said, the mother of all taxpayer-funded gifts still sits in the wings, and it is the John Murtha Center for Biosecurity at UPMC.

Murtha's America . . .

by Paul Jacobs, Townhall: As 2009 drew to a close, the Office of Congressional Ethics ended its investigation of Rep. John Murtha (D-Pa.) and several other congressmen associated with PMA Group, a lobbying firm. The Office recommended against a full-fledged House ethics investigation.

At issue? A pattern whereby Congressman Murtha, Norm Dicks (D-Wash.), and James Moran (D-Va.), earmarked hundreds of millions of tax dollars to clients of PMA Group and then, magically, millions of dollars in campaign contributions from PMA and its clients found their way to Murtha’s campaign account, and the campaigns of others involved.

Some will fret that the ethics process is not doing its job. That’s probably true, if not in this particular case, surely in scores of other cases that have resulted in light wrist-slapping, a harshly worded letter or no punishment at all.


But let’s suppose that what Murtha and others in Congress are doing — gathering up our hard-earned tax dollars and distributing them to friends and cronies in hopes of spurring economic growth — is fully legal. Is it right? Is it good? Does it build a strong country and enhance our individual liberty?

Stop laughing. Wonder as we may about backroom deals and hard-to-find quid pro quo corruption, what about the obvious corruption right smack dab in front of our face? You know, the kind that tends to be fully legal.

Perhaps corruption is too strong a word. But whether the action is an illegal bribe or just a smart, savvy method of parochial, self-interested pork politics — whereby an incumbent uses the public treasury to win friends and influence people — it sure seems crooked.

Murtha argues his earmarks are creating jobs, revitalizing the depressed local economy. It’s not about him; it’s about his constituents. Never mind the earmark-built and maintained John P. Murtha Airport in Johnstown, Pennsylvania, where three flights a day take off for Washington under a giant, smiling picture of the congressman.

Murtha’s job creation racket doesn’t create many jobs. According to a Washington Post report, “For all the billions in federal contracts the congressman has steered to the region in the past ten years, now at a rate of $100 million a year, joblessness in his distressed district has not improved.”

Moreover, some of the jobs generated have cost a million dollars — or twice that. For example, Planning Systems, Inc. in Uniontown, Pennsylvania, created four jobs using $7 million in earmarks.

Another company to receive Murtha earmark help was Caracal, Inc., To great hoopla, Murtha delivered the ton of tax dollars to Caracal, claiming, “Today’s ribbon-cutting ceremony is yet another indication that our investment in this region’s economic revitalization is paying off.” After receiving more than $150 million in taxpayer help, the company went under. That’s zero sustainable jobs.

With Caracal out of business, the operative question might be, “‘Paying off’ for whom?” That “whom” now seems to cover a lot of people, for our earmark culture is not limited to Congress. It’s growing. The same economic model behind Murtha’s earmark use underpins last year’s stimulus spending and a likely follow-up round this year. The idea intrinsic to earmarks and government job creation is that politicians and bureaucrats can spend our money better than we can. We just waste our money; they are the great and wise spenders. Though absurd on the face of it, the notion has much to recommend it . . . if you are on the taking end of the practice.

The earmark culture in Congress, so well represented by Congressman Murtha, the new King of Pork, isn’t merely symptomatic of the problem in Washington, it is also emblematic.
